Remind MLOs About the SAFE Act’s “Successive Years” Rule


We continue to see a fair number of MLOs completing the same course two years in a row which is creating a problem for some people.   Please remember that the SAFE Act stipulates that state-licensed MLO “may not take the same approved course in the same or successive years to meet the annual requirements for continuing education.”  NMLS has interpreted the term “successive years” to mean two years in a row.

MLOs and providers are advised that if an individual completes the same course two years in a row, the information will be recorded in NMLS, but CE credit hours will not be applied towards meeting annual requirements (and the MLO will likely not be able to file for renewal).  Additional information about the “successive years” rule is posted in the course provider section of the Resource Center under Notices and Example at: http://mortgage.nationwidelicensingsystem.org/courseprovider/Pages/Resources.aspx
